Terms of Service

1. Acceptance of Terms

By accessing or using the Panops platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Panops provides an intelligence platform that aggregates publicly available and licensed private data sources for research, investigation, and personal security purposes. The Service includes data access, analysis tools, visualization features, and API integrations as described on our platform pages.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. You must provide accurate, current, and complete information during the registration process.

4. Account Registration and Security

To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Panops of any unauthorized use of your account or any other breach of security.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service for stalking, harassment, or intimidation of any individual
• Use the Service to violate any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use the Service to compile data for the purpose of sending unsolicited communications
• Resell, redistribute, or sublicense access to the Service or its data without prior written consent
• Use automated means to scrape, crawl, or extract data from the Service beyond authorized API usage
• Use the Service in any manner that could damage, disable, or impair the Service

6. Data Usage and Compliance

All data provided through the Service is intended for legitimate research, investigative, and security purposes. Users are responsible for ensuring their use of data obtained through the Service complies with all applicable laws, including but not limited to the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), and applicable state privacy laws. Panops does not provide consumer reports as defined by the FCRA.

7. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis at Panops' discretion. Prices are subject to change with 30 days' notice.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Panops and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any portion of the Service without prior written consent.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Panops makes no warranties, expressed or implied, regarding the accuracy, completeness, reliability, or availability of any data or content provided through the Service. Panops does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

10. Limitation of Liability

In no event shall Panops, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

11. Termination

Panops may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

Panops reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Continued use of the Service after changes constitutes acceptance of the revised Terms.
